FORM W-7 EXCEPTIONS

Form W-7 Exceptions: When a Tax Return May Not Be Required

Most ITIN applications include a U.S. federal tax return, but the IRS lists specific exceptions. The exception and supporting evidence must match the applicant’s actual federal tax purpose.

Quick answer

Can you apply for an ITIN without a tax return?

Sometimes. Form W-7 instructions contain specific exceptions to the usual requirement to attach a U.S. federal income tax return. An applicant using an exception must identify the correct exception and submit the required supporting documentation.

An exception is not a shortcut around the federal tax-purpose requirement.

How exceptions work

The exception must be tied to a documented tax purpose

IRS exceptions cover defined situations in which a taxpayer identification number is needed even though a federal income tax return is not attached to Form W-7. Depending on the exception, evidence may come from a withholding agent, financial institution, partnership, mortgage transaction, U.S. real-property transaction or another IRS-recognized reporting requirement.

The exact document list changes by exception. Use the current Instructions for Form W-7 rather than relying on an old checklist.

2026 partnership update: Effective June 1, 2026, the IRS says CAAs submitting Form W-7 applications that claim Exception 1(a) for partnership income must include the relevant portion of the partnership or LLC agreement showing the partnership name, EIN, and the applicant’s name and signature, together with evidence that the applicant is a partner in a partnership conducting business in the United States.

Before claiming a Form W-7 exception

  • Confirm the applicant has a real federal tax purpose that fits an IRS-listed exception.
  • Use the exact current exception category and code in the Form W-7 instructions.
  • Gather the exception-specific letter, contract, agreement, withholding document or other evidence before filing.
  • Make sure the name and identifying information on the exception evidence match Form W-7.
  • Check for recent IRS updates to the exception before submission.

If you believe a Form W-7 exception applies, send a short description of the transaction or reporting requirement before sending the supporting evidence itself.
